9. Acceptable use

You may use the Website only for lawful purposes. You may not use the Website:

  • in any way that breaches any applicable local, national or international law or regulation;

  • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;

  • to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards (see below);

To the fullest extent permitted by law, we, our group companies, and our and their directors, officers, employees, agents, partners and contractors will not be liable to you, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any:

  • business interruption;

  • loss of anticipated savings;

  • loss of business opportunity, goodwill or reputation;

  • loss or corruption of data; or

15. Governing law and jurisdiction

These Terms, their subject matter and their formation, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of the Island of Guernsey.

You and we both agree that the courts of the Bailiwick of Guernsey will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims), except that if you are a consumer resident in the United Kingdom, you may also bring proceedings in the courts of the part of the United Kingdom in which you live.

16. General

If any provision of these Terms is found to be invalid, illegal or unenforceable by any court of competent jurisdiction, the validity, legality and enforceability of the remaining provisions will not be affected.

If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations.

These Terms, the Privacy Policy and any documents referred to in them constitute the entire agreement between you and us in relation to your use of the Website and supersede any prior agreements, representations or understandings between us in relation to that subject matter.

A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) (Guernsey) Law, 2014 or any equivalent legislation in any other jurisdiction to enforce or enjoy the benefit of any provision of these Terms.
